Client Terms of Service
1. Business-to-Business Agreement
These Client Terms of Service apply to website and payment-setup services provided by Michael J. Rooney d/b/a RooneyBuilds ("RooneyBuilds") to the business or organization purchasing a plan (the "Client"). These plans are offered for business use, not for personal, family, or household use.
By checking the agreement box at checkout and completing payment, the Client confirms that it has authority to bind the business, has reviewed these Terms, and agrees electronically to the selected plan, recurring billing, and cancellation terms.
2. Selected Plan and Monthly Fees
The plan, monthly price, billing frequency, and any applicable tax shown on the Stripe checkout page and receipt are incorporated into these Terms.
Website Plan - $89 per month, plus applicable tax: a premium, mobile-friendly one-page website; hosting; domain connection; support; and continuous reasonable updates to the existing website.
Website + Payments Plan - $130 per month, plus applicable tax: everything in the Website Plan, plus initial setup and connection of a Client-owned Stripe account or comparable payment system, a customer portal, website payment button(s), and one core payment flow selected by the Client, such as a monthly membership, recurring subscription, appointment payment or deposit, or one-time checkout page.
There is no down payment or upfront website-build fee under these subscription plans. Third-party charges, including domain registration or renewal, payment-processing fees, premium software, paid integrations, taxes, chargebacks, refunds, or bank fees, are not included unless stated in writing.
3. Recurring Billing Authorization
The Client authorizes RooneyBuilds and its payment processor to charge the payment method supplied at checkout for the selected monthly amount and applicable tax. Charges recur monthly until cancellation becomes effective.
The Client is responsible for keeping billing information current. RooneyBuilds may retry failed payments and may pause work, support, or hosting after notice while an account is overdue.
4. 12-Month Plan; Cancel Anytime
The selected service is described and priced as a 12-month plan. However, the Client may cancel at any time without an early-termination fee and will not owe future monthly payments after cancellation becomes effective.
Cancellation takes effect at the end of the current paid billing period unless the Client requests immediate termination. Monthly fees already charged are nonrefundable except where required by law.
After the first 12 months, the subscription continues month-to-month until canceled. RooneyBuilds will provide advance notice of any material change to price or recurring terms.
5. How to Cancel and What Happens
The Client may cancel through the Stripe customer portal when available or by emailing miroon9889@gmail.com. RooneyBuilds will confirm cancellation in writing.
When cancellation becomes effective, RooneyBuilds will stop future subscription charges, updates, support, and hosting. The website will be unpublished and will no longer be publicly available through RooneyBuilds.
The Client retains ownership of its domain name, trademarks, logos, photographs, and other Client-provided content. The Client does not receive the RooneyBuilds website build, source code, reusable components, platform account, or hosting account unless a separate written transfer or buyout agreement is made and the platform technically permits transfer.
6. Continuous Updates and Reasonable Use
While the subscription is active and paid, the Client may submit update requests continuously. RooneyBuilds does not impose a fixed monthly number of routine update requests under the current plans.
Included updates are reasonable changes to the existing one-page website, such as correcting text, updating hours, prices, contact details, images, links, announcements, services, or calls to action.
Continuous updates do not include a complete redesign, a second website, new multi-page builds, ecommerce catalogs, custom software, large data or product uploads, advanced booking systems, complex automations, ongoing copywriting campaigns, social-media management, or major integrations. Work outside the existing website scope may require a separate quote or plan change.
Updates are handled in a reasonable queue based on complexity and availability. RooneyBuilds does not promise 24/7 completion or a guaranteed same-day turnaround.
7. Website + Payments Plan
For the $130 plan, the payment account must belong to the Client. The Client is responsible for its legal business information, bank account, tax information, pricing, refund and cancellation policy, customer communications, and compliance with Stripe or other processor rules.
RooneyBuilds may assist with creating or configuring the Client-owned account, connecting checkout or subscription buttons to the website, setting up one core payment flow, enabling a customer portal, and providing basic technical billing support.
RooneyBuilds is not the merchant of record, does not hold Client funds, and is not responsible for payment-processor approval, transaction fees, refunds, chargebacks, fraud losses, taxes, customer disputes, bookkeeping, financial advice, or uninterrupted payment processing. Additional products, pricing tiers, migrations, booking systems, or complex workflows may require separate pricing.
8. Client Responsibilities
The Client must provide accurate business information, prices, hours, policies, service descriptions, images, logos, links, and account access needed for the project.
The Client confirms that it owns or has permission to use all submitted materials and is responsible for reviewing and approving factual accuracy before launch.
The Client is responsible for industry-specific legal requirements, licenses, accessibility obligations, health or professional claims, refund policies, privacy notices, and terms governing its own customers.
9. Website Creation, Approval, and Launch
RooneyBuilds will create a premium, mobile-friendly one-page website based on the Client's information and selected plan. Timing depends on the Client providing materials and feedback promptly.
Approval may be given by email, text, checkout, electronic signature, or written launch authorization. After launch, routine revisions are handled under the continuous-updates policy.
10. Domain, Hosting, Platforms, and Availability
The Client should own and control its domain name. RooneyBuilds may assist with domain connection and DNS settings. Domain registration and renewal costs are separate unless expressly included in writing.
Hosting, forms, payment processing, and other functions may rely on third-party platforms. RooneyBuilds will use reasonable care but cannot guarantee uninterrupted uptime, permanent platform availability, or compatibility with every future browser, device, or third-party service.
11. Ownership and License While Active
The Client owns Client-provided content, logos, photographs, trademarks, and its domain. RooneyBuilds retains ownership of its methods, templates, layouts, reusable components, processes, know-how, and the website build unless a separate written transfer or buyout is completed.
While the subscription is active and paid, RooneyBuilds grants the Client a limited, nonexclusive license to use the completed website for the Client's business. That license ends when the subscription ends, and the site is unpublished.
12. Search Engines and Business Results
RooneyBuilds may provide basic local-search setup, metadata, maps, and submission guidance. RooneyBuilds does not guarantee indexing, search ranking, traffic, leads, appointments, sales, memberships, revenue, uptime, or any other specific result.
13. Suspension and Termination by RooneyBuilds
RooneyBuilds may suspend or terminate service for nonpayment, unlawful or infringing content, fraud, abusive conduct, security risks, repeated misuse, or a material breach that is not corrected after reasonable notice.
If RooneyBuilds terminates without Client breach, RooneyBuilds will stop future subscription charges and provide any refund required by law for prepaid service not provided.
14. Confidentiality and Portfolio Use
Each party will use reasonable care to protect nonpublic business information received from the other.
Unless the Client declines in writing, RooneyBuilds may display the finished public website, business name, screenshots, and an honest description of the project in its portfolio. RooneyBuilds will not disclose private account credentials, financial information, or confidential business records.
15. Disclaimers and Limitation of Liability
RooneyBuilds will perform services in a professional and workmanlike manner. Except for that promise, services are provided "as is" and "as available" to the maximum extent permitted by law.
To the maximum extent permitted by law, RooneyBuilds and Michael J. Rooney are not liable for indirect, special, incidental, punitive, or consequential damages, lost profits, lost data, third-party outages, chargebacks, customer disputes, or lost business opportunities.
RooneyBuilds' total liability arising from a plan will not exceed the amount the Client paid to RooneyBuilds during the three months before the event giving rise to the claim, except where applicable law does not permit that limitation.
16. General Terms
These Terms, the checkout page, the payment receipt, and any written project description form the complete agreement for the selected plan. A material change must be confirmed in writing.
Connecticut law governs. If any provision is unenforceable, the remaining provisions remain effective. Electronic acceptance and records are valid. Notices may be sent to the email addresses used at checkout.
17. Website Visitor Terms
The RooneyBuilds website provides general information and examples. Requesting a consultation does not require RooneyBuilds to accept a project. Visitors may not misuse the website, attempt unauthorized access, introduce malware, scrape content in a harmful manner, impersonate another person, or submit unlawful material.
RooneyBuilds website content, branding, layouts, and original materials may not be copied, sold, republished, or commercially exploited without written permission. Third-party links are governed by their own terms and policies.
Privacy Policy
RooneyBuilds respects privacy. This policy explains the information RooneyBuilds collects, how it is used, and the choices available to website visitors, prospects, and clients.
1. Information We Collect
Information you provide, including your name, email address, phone number, business name, location, project details, messages, consultation requests, website content, logos, images, and account information you choose to share.
Transaction and subscription records, such as plan selected, billing status, invoices, and payment history. Stripe or another payment processor collects and processes card or bank information; RooneyBuilds does not directly store full payment-card numbers.
Basic technical information that hosting and security providers may collect automatically, such as IP address, browser, device type, referring page, pages viewed, and access times.
2. How We Use Information
To respond to inquiries, provide consultations, create and maintain websites, configure payment features, process subscriptions, send receipts and service notices, provide support, prevent fraud, maintain records, improve services, and comply with legal, tax, and accounting obligations.
3. How We Share Information
RooneyBuilds does not sell personal information. Information may be shared with service providers that support hosting, website forms, file storage, payment processing, email, analytics, scheduling, electronic signatures, accounting, or security.
Information may also be disclosed when required by law, to protect rights or safety, investigate fraud or misuse, enforce agreements, or as part of a business transfer.
4. Payment Processing and Client Payment Systems
Payments to RooneyBuilds are processed by Stripe or another disclosed processor under that provider's privacy and security practices.
When RooneyBuilds helps a Client configure the Client's own payment system, customer payment information belongs to and is controlled by the Client and its processor. RooneyBuilds may have limited authorized administrative access for setup or support but will not use that information for unrelated purposes.
5. Cookies, Analytics, and Third-Party Links
The website may use essential technologies needed for hosting, security, forms, and functionality. If nonessential analytics, advertising pixels, or additional cookies are added, this policy and any required notice will be updated.
Links to Stripe, scheduling tools, maps, social platforms, client websites, and other third parties are governed by those parties' policies.
6. Data Retention
RooneyBuilds retains information for as long as reasonably needed to provide services, maintain business and tax records, enforce agreements, resolve disputes, prevent fraud, and meet legal obligations. Information may be deleted or anonymized when no longer reasonably needed.
7. Security
RooneyBuilds uses reasonable administrative and technical measures intended to protect information. No website, email, storage system, or internet transmission is completely secure, and absolute security cannot be guaranteed.
8. Your Choices and Requests
You may request access, correction, or deletion of personal information by contacting miroon9889@gmail.com. Requests may be limited where information must be retained for legal, tax, contractual, fraud-prevention, or security purposes.
You may opt out of promotional messages. Service, billing, security, and transactional messages may still be sent when necessary.
9. Children's Privacy
RooneyBuilds is intended for business owners and organizations and is not directed to children under 13. RooneyBuilds does not knowingly collect personal information from children under 13.
10. Changes to This Policy
This Privacy Policy may be updated as services, technology, or legal obligations change. The updated version will be posted with a revised effective date.

Electronic Acceptance
By checking the required agreement box and completing checkout, the Client acknowledges that it has read, understands, and agrees to these Client Terms of Service and Privacy Policy, including the recurring monthly charge and cancellation consequences.
